End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Creative Factory for the Tend application and any updates, together the "Licensed Application." By downloading or using Tend, you agree to this EULA. This EULA incorporates the standard terms required by Apple for licensed applications.

1. Scope of license

The Licensed Application is licensed, not sold, to you. The license granted is a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

2. Permitted use and restrictions

You may use Tend for your own personal, non-commercial care-documentation purposes. You may not: copy (except as permitted by this license), reverse-engineer, decompile, disassemble, modify, or create derivative works of the Licensed Application, except to the extent such restriction is prohibited by applicable law.

3. Data and privacy

Tend stores the records you create on your device. Creative Factory does not collect or receive those records. Your use of Tend is also subject to our Privacy Policy.

4. Subscriptions

Optional Tend Premium subscriptions, including any free trial, are sold through the App Store and are subject to the subscription terms described in our Terms of Service and to Apple's terms. Auto-renewable subscriptions renew unless cancelled at least 24 hours before the end of the current period and can be managed in your App Store account settings.

5. Not professional advice

Tend is a personal documentation tool only. It does not provide medical, legal, diagnostic, emergency, or child-protection advice, and is not a recording, monitoring, or surveillance product.

6. No warranty

To the maximum extent permitted by applicable law, the Licensed Application is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. Creative Factory disclaims all warranties and conditions, whether express, implied, or statutory.

7. Limitation of liability

To the extent not prohibited by law, in no event shall Creative Factory be liable for personal injury or any incidental, special, indirect, or consequential damages, including loss of data, arising out of or related to your use of the Licensed Application.

8. Maintenance and support

Creative Factory is solely responsible for providing any maintenance and support for Tend, as specified in this EULA or as required by applicable law. Apple has no obligation to furnish any maintenance and support services with respect to the Licensed Application.

9. Third-party beneficiary

You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

10. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
