Terms of Service

These Terms of Service ("Terms") govern your use of the Tend mobile application ("Tend", "the app"), provided by Creative Factory ("we", "us"). By downloading or using Tend, you agree to these Terms. If you do not agree, please do not use the app.

1. What Tend is

Tend is a personal note-taking and documentation tool for parents and caregivers to record observations about a child's day and to prepare those notes for conversations or their own records.

Important — what Tend is not. Tend is not a medical, diagnostic, legal, emergency, or child-protection service, and it is not a substitute for professional advice or care. It does not diagnose conditions, interpret injuries, detect or prove wrongdoing, or provide a recording, monitoring, or surveillance function. Information you record is your own observation. If you believe a child is in immediate danger, contact local emergency services or the appropriate authority.

2. License to use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Tend for your own personal, non-commercial purposes, subject to these Terms and the End User License Agreement.

3. Your responsibilities

You are responsible for the accuracy of the information you record and for how you use any reports you create or share.
You agree to use Tend lawfully and not to record or document others in violation of applicable privacy or recording laws.
You are responsible for keeping your device secure. Because records are stored on your device, deleting the app or losing the device may result in permanent loss of your data.

4. Subscriptions and free trial

Tend offers core note-taking for free and an optional Tend Premium subscription that unlocks additional features. Subscriptions may include an introductory free trial (for example, a 3-day free trial on the weekly plan).

Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period.
If a free trial is offered and you subscribe, any unused portion of the trial is forfeited when you purchase a subscription, where applicable.
You can manage or cancel your subscription in your App Store account settings after purchase.
Prices are shown in the app and on the App Store and may vary by region.

Purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple in accordance with their policies.

5. Intellectual property

Tend, its design, and its content (excluding the records you create) are owned by Creative Factory and protected by applicable laws. The records you create belong to you.

6. Disclaimers

Tend is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that data stored on your device will not be lost.

7. Limitation of liability

To the maximum extent permitted by law, Creative Factory shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use Tend.

8. Changes

We may update these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date reflects the current version.

9. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law provisions.
